A JOINT RESOLUTION
|
|
proposing a constitutional amendment authorizing garnishment of |
|
wages for court-ordered restitution in a criminal judgment. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 28, Article XVI, Texas Constitution, is |
|
amended to read as follows: |
|
Sec. 28. No current wages for personal service shall ever |
|
be subject to garnishment, except for the enforcement of |
|
court-ordered: |
|
(1) child support payments; [or] |
|
(2) spousal maintenance; or |
|
(3) restitution in a criminal judgment. |
|
SECTION 2. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 3, 2009. |
|
The ballot shall be printed to permit voting for or against the |
|
proposition: "The constitutional amendment authorizing |
|
garnishment of wages for court-ordered restitution in a criminal |
|
judgment." |
